As you know, we represent BRW Contracting LLC (“BRW”) in the above matter. This is BRW’s Notice of Contest of all aspects of the Citation and Notification of Penalty. Specifically, BRW contests the following: i) that the cited standard applies; ii) that the cited standard was violated; iii) that any employees were exposed to a hazard; iv) that BRW knew, or should have known, of the alleged violation/hazard; and v) the penalty, abatement, and classification. BRW reserves the right to raise, and rely upon, any and all factual and legal defenses, including affirmative defenses, as this matter progresses. The purpose of the communication is to submit the Notice of Contest.
