FINDINGS & ORDER APPROVING SETTLEMENT AGREEMENT
On August 1, 2025, the Division of Occupational Safety and Health of the Industrial Commission of Arizona (“ADOSH” or “Division”) conducted an inspection at a worksite location of Nokona Leather Goods Co., LLC and Nokona Bats, LLC (“Respondents”) located at 4602 East Thomas Road, Phoenix, AZ 85018, Inspection Nos. UR-2025-MG193-0007 and CP-2025-MG193-0004. These inspections resulted in ADOSH issuing two Citation and Notification of Penalty Notices to the Respondents on January 15, 2026.
WHEREAS, Respondents timely filed Notices of Contest with respect to the above-mentioned citations, and the Division and Respondents now desire to settle these matters without the necessity of a formal hearing, all parties agree that it is in their respective best interests to settle this matter without going through the procedures, time and expense associated with litigation and a formal hearing.
FINDINGS AND CONCLUSIONS
NOW, THEREFORE, the parties agree to settle this matter as follows:
On July 8, 2026, the parties filed a Settlement Agreement resolving all issues and disputes involved in this consolidated matter. The Settlement Agreement appears to be consistent with the provisions and objectives of the Arizona Occupational Safety and Health Act. Accordingly, pursuant to A.A.C. R20-5-827 of the Occupational Safety and Health Rules of Procedure Before the Industrial Commission of Arizona, the Settlement Agreement is incorporated by this reference, adopted, and made a part of this order.
The Settlement Agreement is in furtherance of the purpose of the Arizona Occupational Safety and Health Act of 1972 and represents a full and final determination of this matter.
ORDER
IT IS HEREBY ORDERED that:
All duplicate citations and penalties issued against Nokona Leather Goods Co., LLC under inspection UR-2025-MG193-0007 are deleted.
Inspection CP-2025-MG193-0004, Citation 1 Item 1a is reclassified from “Serious” to “Non Serious”, and the assessed penalty is reduced to $0.00.
Inspection CP-2025-MG193-0004, Citation 1 Item 1b is deleted.
Inspection CP-2025-MG193-0004, Citation 1 Item 1c is deleted.
Inspection CP-2025-MG193-0004, Citation 1 Item 1d is deleted.
Inspection CP-2025-MG193-0004, Citation 1 Item 2a is reclassified from “Serious” to “Non Serious”, and the assessed penalty is reduced to $0.00.
Inspection CP-2025-MG193-0004, Citation 1 Item 2b is deleted.
Inspection CP-2025-MG193-0004, Citation 1 Item 2c is deleted.
IT IS FURTHER ORDERED that Respondents:
Contact ADOSH consultation within 30 days of the effective date of the Settlement Agreement to schedule two comprehensive consultation visits one at each of Respondent, Nokona Leather Goods Co LLC’s Arizona operations with ADOSH Consultation Services to be completed in the 6-month period following the effective date of this Settlement Agreement.
Contact ADOSH Consultation within 30 days of the effective date of the Settlement Agreement to schedule “OSHA 30” training with the ADOSH trainer to be completed by all Nokona Leather Goods Co LLC’s managers within the 6-month period following the effective date of the Settlement Agreement.
Contact Contact ADOSH Consultation within 30 days of the effective date of the Settlement Agreement to schedule “OSHA 10” training with the ADOSH trainer to be completed by all Nokona Leather Goods Co LLC’s front-line supervisors within the 6-month period following the effective date of the Settlement Agreement.
Contact ADOSH Consultation within 30 days of the effective date of the Settlement Agreement to schedule “ADOSH 101 OSHA Respirator Protection” training with the ADOSH trainer to be completed by all Nokona Leather Goods Co LLC’s managers and supervisors within the 6-month period following the effective date of the Settlement Agreement.
Shall provide ADOSH with a Heat Safety and Hydration Plan that accounts for shade and ice chests and provide documentation verifying an investment of $3,000.00 toward implementing the Heat Safety and Hydration Plan for employees that are traveling to outdoor sites within 30 days of the effective date of the Settlement Agreement.
Shall submit all documentation and correspondence required under the settlement agreement via email to [email redacted].
Shall submit the Abatement Certification and supporting abatement documentation to [email redacted] within 30 days of this Findings & Order Approving Settlement Agreement.
IT IS FURTHER ORDERED that each party is to bear its own attorney’s fees and costs.
NOTICE
Any party dissatisfied with this Decision may request review by the Review Board, filing a written request with the Administrative Law Judge Division of the Industrial Commission within fifteen (15) days after service of this Decision as provided by Arizona Revised Statutes, §§ 23-421(C) and 23-423(A) and (B). If no such request is made within the time provided, this Decision becomes final.
