ORDER VACATING HEARING
On July 30, 2024, the referring agency issued a Notice of Hearing in the above-captioned matter which scheduled a hearing on October 09, 2024, before the Office of Administrative Hearings (“OAH”).
On October 06, 2024, counsel for the Division of Occupational Safety and Health submitted a Motion to Continue and Set Status Update Deadline to OAH. Receiving no objection on behalf of Respondent, OAH granted the motion.
As a result, on October 07, 2024, OAH issued an Order Granting Continuance which set a Status Update from Complainant no later than November 07, 2024. Correspondence was not returned as undeliverable.
As a courtesy, on November 12, 2024, Complainant was electronically informed that the matter would be vacated unless a Status Update was received on its behalf before the end of the day. Said correspondence was not returned as undeliverable. To date, Complainant has not filed a Status Update with OAH. Therefore,
IT IS ORDERED that, pursuant to Ariz. Admin. Code R2-19-111(4), this matter is hereby vacated from OAH’s calendar and is remanded to the referring agency for further action, if any.
