ORDER
CP-2023-Q6169-0037-ADOSH · Arizona Division of Occupational Safety and Health · 2025-10-02
IN THE OFFICE OF ADMINISTRATIVE HEARINGS
DIVISION OF OCCUPATIONAL SAFETY AND HEALTH OF THE INDUSTRIAL COMMISSION OF ARIZONA,
Complainant,
v.
EMJ CONSTRUCTION, LLC,
Respondent.
No. CP-2023-Q6169-0037-ADOSH
ORDER
On October 1, 2025, Complainant submitted a Motion to Continue. The Motion is granted. The hearing will be conducted on December 1 and 2, 2025, from 9:00 AM to 5:00 PM. Unless otherwise requested, the hearing will be conducted in person.
On August 21, 2025, the Tribunal ordered that future filings should be provided in PDF format. The October 1, 2025, Motion did not comply with that request. Accordingly, the Tribunal will repeat itself this once and provide an explanation as to why the current submission style of Complainant is disfavored. Future non-compliant submissions may be rejected.
As submitted, motions are provided to the ALJ as small, single-spaced, all-bold text on what is effectively a cover sheet. Often, portions of that text are covered by the OAH emblem. It is unpleasant to read anything more than a brief summary of a submission. Much like you would not put the substantive text on a cover sheet or in an email for any other judge, the Tribunal would prefer all written submissions be in a moderately formal format. At the very least, please submit writings as a PDF with normal legal formatting.
Done this day, October 2, 2025.
