This matter was scheduled for administrative hearing on Thursday, September 23rd, 1999, at 8:30 a.m., in Yuma, Arizona. On September 21st, 1999, the Complainant, Ms. Evelyn Kuida, filed with the Office of Administrative Hearings (OAH) a letter in which she explained that she and the Respondent had reached an agreement as to all outstanding issues before the Registrar of Contractors on this case. According to the letter, Respondent and Complainant have agreed that Respondent will remove from Complainant’s premises all his materials he had constructed pursuant to their contract, and Complainant agrees to re-paint and repair any of the stucco and fill any holes left by the removal. Complainant stated her request that the Office of Administrative Hearings cancel the hearing. This letter is received as a Motion to Vacate. Respondent indicated to the OAH his agreement that the hearing should be vacated based on the parties’ agreement.

WHEREFORE, good cause appearing this administrative hearing is vacated and this matter returned to the Registrar of Contractors with a recommendation that Citation and Complaint Number Y99-0134, together with the complaint on which it is based, be closed.
