Prior to the hearing, the Appellant and the Registrar had entered a settlement whereby the Appellant paid a civil penalty in the agreed amount of $1,500.00. The Appellant notified the Office of Administrative Hearings of this settlement but the State did not confirm the settlement or join in the withdrawal of the appeal. Recommended Order In view of the foregoing; It is hereby recommended that the Appeal of Barnard Construction Company, Inc. be Dismissed .
