This matter came on for hearing on January 25, 1999 before Administrative Law Judge, Mark Silver. The Registrar of Contractors was represented by Assistant Attorney General, Montgomery Lee. Respondent did not appear at the hearing. Based upon the entire record, the following Findings of Fact, Conclusions of Law, and Recommended Order are made:

FINDINGS OF FACT

1. At the outset of the scheduled hearing, Complainant averred that the parties had concluded a settlement agreement prior to the date of the instant hearing. 2. Pursuant to the terms of the aforementioned settlement agreement, Complainant had agreed to dismiss the instant matter without prejudice.

CONCLUSIONS OF LAW

1. The policy of the law favors settlements of disputes and adverse parties should be free to adjust their differences by entry into agreements or stipulations of settlement, which should be recognized and given effect by all tribunals.

RECOMMENDED ORDER

In view of the foregoing, it is recommended that Citation No. R99- 0020, together with the Complaint upon which it is based, be dismissed.
