Shortly before the convening of the scheduled hearing in this matter, the Registrar of Contractors, through its counsel, filed a motion to vacate the hearing. The reason given for the motion was that all issues relating to the Citation and Complaint in this matter had been previously adjudicated and disposed of by the parties in Docket No. 98F-0016-ROC. Due to the late filing of the Registrar’s motion, the hearing was convened and the motion addressed as a preliminary matter. Counsel for Respondent acknowledged receiving the motion and announced that Respondent had no objection to it. The tribunal treated the Registrar’s request as a motion to dismiss the Citation and Complaint. Counsel for the parties had no objection. In view of the foregoing, it is recommended to the Registrar of Contractors that the Citation and Complaint in this matter be dismissed.
