By Notice of Hearing issued on August 19, 1999, hearing was set for October 4, 1999, before the undersigned administrative law judge of the Office of Administrative Hearings. Subsequently, on September 14, 1999, Respondent Ken Millsap dba The Becken Company filed by facsimile NOTICE OF BANKRUPTCY in Bankruptcy Case No. 99 10524 PHX GBN, United States District Court, District of Arizona. Presuming the accuracy of that facsimile regarding Respondent’s petition for bankruptcy, there now exists as a direct result of that petition, an automatic stay of proceedings against Respondent pursuant to U.S.C. § 362(a). Therefore, good cause appearing, the hearing set for October 4, 1999, is canceled and the above-entitled case is vacated from the calendar of the Office of Administrative Hearings and IT IS HEREBY RECOMMENDED that the Citation in Case No. M99-1269, together with the Complaint upon which it is based, shall be closed unless Complainant files notice with the Registrar of Contractors, on or before the effective date of the Registrar’s Order entered in this matter, that it has instituted proceedings before the Federal Court seeking relief from the aforesaid automatic stay.
