IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was set for hearing on August 8, 2000. On August 7, 2000, Complainant Mr. Jon H. Morton, wrote a letter stating that the parties had settled this matter, and he asked “to close the administrative hearing.” Mr. Morton stated that Respondent Mike’s Construction Company “agrees to provide a chemical package with a value of $125 - 150 within the next ten days at no charge to me.” On August 8, 2000, Mr. Jack D. Page, Respondent’s Chief Financial Officer, appeared at the hearing and confirmed that such was the agreement of the parties, and that the chemical package would soon be delivered to Mr. Morton. Parties may resolve a contested case by agreed settlement. Arizona Revised Statutes § 41-1092.07(F)(5). Accordingly, IT IS ORDERED vacating the hearing and recommending to the Registrar that Citation and Complaint No. M99-1251 be closed. ORDERED AND SUBMITTED this 8th day of August, 2000.
