IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On August 31, 2000, a compliance hearing was scheduled to determine if the Respondent had violated provisions of A.R.S. §32-1154(A). On August 30, 2000, the undersigned Administrative Law Judge received a Notice of Settlement/ Request for Continuance from J. Brent Welker, the Complainant’s attorney, requesting a continuance in this matter to allow the Respondent additional time to perform corrective work pursuant to a settlement agreement between the parties.

Based upon the foregoing, the undersigned Administrative Law Judge ordered that the hearing scheduled for August 31, 2000, at 9:00 a.m. be continued to a later date if necessary. The undersigned Administrative Law Judge further ordered that the Complainant submit a written Status Report to the undersigned Administrative Law Judge by October 6, 2000. The Status Report was to set forth the status of the above referenced settlement. The Complainant was also ordered to indicate if a hearing would be necessary.

On October 6, 2000, the undersigned Administrative Law Judge received a Status Report/Notice of Completion from J. Brent Walker, the Complainant’s attorney, stating that the parties have resolved their dispute.

Based upon the foregoing, IT IS ORDERED that the hearing in this matter shall be vacated from the calendar of the Office of Administrative Hearings.
