HEARING: September 27, 1999 APPEARANCES: Miklos M. Pongratz, vice president on behalf of the Applicant- Appellant Patti Shelton, Assistant Attorney General, on behalf of the Registrar of Contractors (Registrar) ADMINISTRATIVE LAW JUDGE: Allen Reed _____________________________________________________________________ This matter came on for hearing as scheduled in the Notice of Hearing. Prior to the receipt of formal testimony, the Applicant-Appellant informed the Administrative Law Judge that it no longer desired the license for which application had been made. The Applicant further stated that he wished to proceed with the hearing in order to recover certain application and related fees if the denial of the application was reversed. The Assistant Attorney General was requested to contact the Licensing Division of the Registrar’s Office to determine the policy of the Registrar in light of A.R.S. §32-1124(C) which provides for forfeiture of an application fee if an application is denied. The parties were informed by the Registrar’s Licensing Division that the application fee was not refundable but that related fees which had been paid (Recovery Fund and Bond), would be returned upon the Applicant withdrawing the appeal. The Applicant stated he wished to withdraw the appeal and the State did not object.

Recommended Order In view of the foregoing it is recommended that the Applicant- Appellant be allowed to withdraw its appeal and that application related fees with the exception of the application fee, be returned to the Applicant-Appellant by the Registrar.
