Hearing in this matter was scheduled to convene in Phoenix, Arizona, on November 17, 1998, at 1:30 p.m., as set by Notice of Hearing issued via certified mail on October 15, 1998, by the Department of Building and Fire Safety. At the time and place scheduled, and for an additional one hour, no one appeared on behalf of either Complainant or Respondent.
CONCLUSIONS OF LAW The burden of proving the allegations of the CITATION AND COMPLAINT issued on July 23, 1998, is on the complaining party, and in this matter that party is Charlotte G. Wright. That burden is by a preponderance of the probative evidence. Because Complainant did not appear to present evidence, her burden has not been met.
RECOMMENDED ORDER In view of the foregoing, it is recommended that the CITATION AND COMPLAINT in Case No. 98-9/023 be dismissed. Done this day, November 17, 1998.
