On September 8, 1999, the undersigned Administrative Law Judge received a Motion To Vacate from Assistant Attorney General Joseph P. Mikitish requesting that the hearing scheduled for September 10, 1999 be vacated because the parties have resolved this dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for September 10, 1999, at 9:00 a.m., shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHERED ORDERED that this matter shall be remanded to the Department of Weights and Measures for any further action that the Director deems appropriate.
