IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date of the scheduled hearing, the Arizona Department of Weights and Measures filed a communication with the Office of Administrative Hearings indicating that this matter had been resolved at a settlement conference held on October 7, 1998. The communication further averred that A & R UNOCAL had accepted the original penalty assessed and therefore, had no desire to proceed with the hearing. Therefore, good cause appearing, the above-entitled case is vacated from the calendar of the Office of Administrative Hearings and it is hereby recommended that this matter shall be closed in accordance with the aforementioned settlement concluded on October 7, 1998.
