On November 3, 1999, a disciplinary hearing was scheduled in this matter. Assistant Attorney General Melissa Cornelius represented the Arizona Board of Dental Examiners (the “Board”). Attorney Alfred W. Ricciardi represented Dr. Maurer. However, Attorney Ricciardi and Dr. Maurer did not appear for the hearing scheduled in this matter.
At the hearing in this matter, Assistant Attorney General Cornelius informed the undersigned Administrative Law Judge that the parties had reached a settlement. However, the Stipulation Agreement had not yet been signed by Dr. Maurer. Accordingly, the Assistant Attorney General requested a two hour continuance to finalize the Stipulation Agreement. The undersigned Administrative Law Judge granted the request for a continuance and adjourned the hearing.
The hearing in this matter reconvened at 11:00 a.m. on November 3, 1999. Assistant Attorney General Cornelius submitted a Motion to Vacate because the parties had finalized the Stipulation Agreement. Based upon the foregoing, IT IS ORDERED that the disciplinary hearing scheduled in this matter shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter shall be remanded to the Board for consideration of the Stipulation Agreement.
