Shortly prior to the date set for the hearing in the above-entitled matter, counsel for Complainant confirmed that all matters in issue between the parties have been resolved by their entry into a mutual agreement of settlement, also effectively requesting that the scheduled hearing be vacated and that the pending administrative action be terminated without prejudice to the reopening of same in the event of any future breach of such agreement by Respondent. In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS ORDERED that the hearing scheduled to convene on August 13, 1999 be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Registrar of Contractors with the recommendation that the entire Citation and Complaint in Cases 99-2496 and 99-2496W be dismissed without prejudice in accordance with the terms of the settlement agreement concluded between the parties.
