This Tribunal conducted a prehearing conference in this matter on May 26, 1999. The purpose of the conference, in part, was to determine, in essence, whether genuine good faith disputes exist as to monies owed between the parties, the work performed, and each party’s compliance with other indivisible contractual obligations. Each party was allowed an opportunity to address the issues and make an offer of proof. After consideration of the parties’ presentations, this Judge found that good faith disputes do, in fact, exist in this matter; that is, that good faith disputes exist as to monies owed between the parties, the work performed, and each party’s compliance with other indivisible contractual obligations. This matter is one that should be pursued in a more appropriate forum. IT IS THEREFORE RECOMMENDED that this matter be dismissed without . . . . . . . . .
