HEARING: May 20, 1999 APPEARANCES: Eugene and Georgine Petrini, Plaintiffs, in their own behalf Mary DeLaat Williams, Assistant Attorney General, on behalf of the State ADMINISTRATIVE LAW JUDGE: Allen Reed _____________________________________________________________________
Findings of Fact This matter came on for hearing at the date and time scheduled in the Notice of Hearing. On September 15, 1998, the Registrar of Contractors issued an Order of Closing in Case No. P98-0273, for the reason that the Defendant’s license had been revoked in another case. The Plaintiffs claimed damages from the Residential Contractors’ Recovery Fund (Fund) in the amount of $10,395.67 for corrective work described in the Corrective Work Order. The claim was denied in its entirety by the Fund and the Plaintiffs requested the instant hearing. Prior to the taking of any evidence, the parties entered into negotiations. The negotiations resulted in the parties reaching a settlement whereby the Fund would pay, and Plaintiffs would accept and receive the amount of $7,000.00 on their claim. Conclusions of Law The law favors settlement of disputes. The settlement set forth in the agreement of the parties is reasonable and voluntary, and is within the jurisdiction of the Registrar under A.R.S. §§32-1132 and 32-1154(E). Recommended Order In view of the foregoing it is recommended, commencing on the effective date of the Order entered in this matter, that the Registrar of Contractors shall commence and finalize payment procedures from the Recovery Fund to Plaintiffs in the amount of $7,000.00 for damages. Done this day, May 20, 1999.
