FINDINGS OF FACT 1. The hearing in this matter was scheduled for 9:00 a.m. on May 4, 1999, in Phoenix, Arizona. As noted above, Complainant did not appear at the appointed time and place. Respondent’s representatives were present and ready to defend. 2. This tribunal waited until 9:30 a.m. to see if Complainant would appear, but he did not. 3. Because Complainant failed to appear and prosecute his claim, the record contains no evidence supporting the complaint. CONCLUSIONS OF LAW 1. Complainant bears the burden of showing, by a preponderance of the evidence, that Respondent has violated the statutes cited in the Citation and Complaint. Culpepper v. State, 187 Ariz. 431, 437, 930 P.2d 508, 514 (Ct. App. 1996). 2. There is no evidence in the record that shows a violation of any statutes cited in the Citation and Complaint. RECOMMENDED ORDER Considering the foregoing findings and conclusions, IT IS RECOMMENDED that complaint 99-1225 against Warren Construction, Ltd. be dismissed.
