A telephonic prehearing conference was held the morning of August 13, 1998, in these consolidated cases. Attending the hearing were Mr. Michael N. Harrison, Assistant Attorney General and legal counsel for the State of Arizona; Mr. Lawrence I. Kazan, Attorney-at-Law and legal counsel to the Respondent, and the undersigned Administrative Law Judge (ALJ). The respective counsel advised the ALJ at the commencement of the conference that the parties had stipulated to a consent order which would, if approved and adopted by the Board of Medical Examiners (the Board), dispose of these cases. Counsel further advised the ALJ that the Board next meets on September 26, 1998, but that they aspire to a consideration of the stipulated consent order by the Board prior to that time, and prior to the presently scheduled date for this administrative hearing to convene, September 1, 1998. Accordingly, the parties, through counsel, jointly moved for a vacation of the presently scheduled hearing date, conditioned upon Board approval, adoption and entry of the stipulated consent order. Counsel assured the ALJ that he and the Office of Administrative Hearings will be timely notified of any Board action on this subject.

Wherefore, it is hereby ORDERED that the administrative hearing of this matter presently scheduled to convene September 1, 1998, at 9:00 a.m., in the Office of Administrative Hearings, Phoenix, Arizona, is VACATED, conditioned upon disposition of these cases by Board entry of the consent order, and notification of the Office of Administrative Hearings of that fact, prior to that date and time.
