This matter came on for hearing as scheduled in the Notice of Hearing. The Complainant did nor appear and no information was received which would show good cause for the failure to appear. The Respondent appeared at the hearing and was prepared to proceed. Cliff Frandsen of the Registrar of Contractors and the Respondent disclosed that the Complainant’s contractor’s license was revoked in another case and the Complainant was no longer in business. The Respondent moved for dismissal of the complaint with prejudice. The Complainant has the burden of proving the allegations of the complaint by a preponderance of the substantial evidence. There being no evidence presented to prove the complaint and there being no good cause shown for the failure of the Complainant to appear at the hearing, the following recommendation is made. Recommended Order It is hereby recommended that the Citation and Complaint upon which it is based be dismissed with prejudice. Done this day, January 25, 1999.
