On March 10, 1999, the Office of Administrative Hearings received a stipulated motion to withdraw appeal and to dismiss without prejudice. The basis for the filing of the motion is that upon Van Waters & Rogers Facility’s (“V W & R”) withdrawal of the appeal, the Arizona Department of Environmental Quality (“Department”) will withdraw its denial of V W & R’s request for a No Further Action determination pending the Department’s completion of its investigation of the former facility.
