IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date of the scheduled hearing, the parties filed a communication with the Office of Administrative Hearings, indicating that this matter had been resolved and canceling the request for a hearing. The parties further stipulated that it was their request that the Arizona Department of Environmental Quality (“Department”) enter an order in this matter incorporating the terms and conditions of the settlement set forth in the December 3, 1999 stipulation, a copy of which is attached hereto. Therefore, good cause appearing, the above-entitled case is vacated from the calendar of the Office of Administrative Hearings and remanded to Department with the recommendation that this matter be closed in accordance with the terms of the December 3, 1999 stipulation.
