Prior to the scheduled hearing date, the parties confirmed that they had concluded a settlement agreement and delivered a copy of the settlement agreement to this office. A copy of the settlement agreement is attached hereto. In view of the foregoing and sufficient cause appearing, IT IS HEREBY ORDERED that the hearing scheduled to convene on January 14, 2000 be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Arizona Department of Environmental Quality with the recommendation that this appeal be closed in accordance with all of the terms and conditions of the attached settlement agreement.
