On January 4, 2000, the undersigned Administrative Law Judge received a Withdrawal of Appeal from the Appellant, stating that the appeal in this matter has been withdrawn because the parties have resolved this dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for February 3-4, 2000 shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
