IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was set for hearing to be held on January 21, 2000 pursuant to the Notice of Hearing issued by the Arizona Department of Environmental Quality (ADEQ) on November 15, 1999. On January 10, 2000, the Office of Administrative Hearings received a copy of a January 10, 2000 letter indicating that the matter was settled between Appellant Tosco and the ADEQ. That filing further stated that Appellant wished to withdraw its request for hearing in the above captioned matter. Therefore, IT IS ORDERED that the hearing in this matter is vacated, and the matter is remanded to the ADEQ for any further handling. ORDERED and DATED this day, January 12, 2000.
