This Matter was scheduled for hearing on December 2, 1999, at 8:30 a.m. On December 1, 1999, the Appellant, by and through Gene Lewis filed a written request that the appeal hearing for this matter be canceled. The Respondent was given an opportunity to respond thereto.

Therefore: Good Cause Appearing, it is recommended that the Director of the Arizona Department of Environmental Quality enter an Order dismissing this appeal. In anticipation of the dismissal, the hearing in this matter is vacated from the calendar of the Administrative Hearings.
