This matter was set for hearing to be held on December 29, 1999 pursuant to the Notice of Hearing issued by the Arizona Department of Environmental Quality (ADEQ) on October 26, 1999. On December 28, 1999, the Office of Administrative Hearings received a copy of a December 23, 1999 letter indicating that the matter was settled between Appellant Equiva Services LLC dba Texaco Refining & Marketing and the ADEQ. That filing further stated that Appellant wished to withdraw its request for hearing. Therefore, IT IS ORDERED that the hearing in this matter is vacated, and the matter is remanded to the ADEQ for any further handling. ORDERED and DATED this day, December 29, 1999.
