IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On November 23, 1999, the undersigned Administrative Law Judge received a letter from Sterling Hundley, Tosco’s Manager of Finance and Budget - Environmental Compliance, stating that the parties have resolved this dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for November 29, 1999, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
