Prior to the hearing in the above-entitled matter, the parties stipulated to dismiss this appeal in light of the Arizona Department of Environmental Quality’s agreement to approve for payment from the State Assurance Fund all except for $1,239.00 of the remaining costs claimed by Appellant and Appellant’s agreement to withdraw its appeal. In view of the parties’ settlement, IT IS ORDERED that the hearing scheduled to convene on October 26, 1999 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that this appeal be dismissed.
