IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date set for the hearing in the above-entitled matter, Appellant informed the Office of Administrative Hearings that Appellant and the Arizona Department of Environmental Quality had resolved the matters in dispute and asked to withdraw the hearing request. In view of the parties’ settlement, IT IS ORDERED that the hearing scheduled to convene on October 20, 1999 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that the appeal in this matter be dismissed.
