IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On October 1, 1999, the undersigned Administrative Law Judge received a facsimile from Assistant Attorney General Joan Card that included a letter from Michael E. Beasley, the Environmental Engineer for Equiva Services, stating that the appeal in this matter has been withdrawn because the parties have resolved this dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for October 4, 1999, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
