Prior to the date set for the hearing in the above-entitled matter, Appellant informed the Arizona Department of Environmental Quality that Appellant was satisfied with the settlement and that it therefore requested that the previously scheduled hearing be canceled. In view of the parties’ settlement, IT IS ORDERED that the hearing scheduled to convene on September 3, 1999 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that this appeal be dismissed.
