IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On September 7, 1999, the undersigned Administrative Law Judge received a facsimile from Assistant Attorney General Joan Card that included a letter from Sterling Hundley, the Finance and Budget Environmental Compliance Manager for Tosco Marketing Company, requesting that the hearing in this matter be vacated because the parties have resolved this dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for September 7, 1999, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHERED ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
