IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date set for the hearing in the above-entitled matter, Appellant informed the Office of Administrative Hearings that the parties had resolved their dispute and asked to withdraw its request for hearing and participation of the Technical Appeals Panel. In view of the parties’ settlement, IT IS ORDERED that the hearing scheduled to convene on August 16, 1999 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that this appeal be dismissed.
