IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On April 13, 1999, the undersigned Administrative Law Judge received a facsimile from David Perez, the Facilities Manager for Beaudry Motor Company. Mr. Perez requested that the hearing scheduled in this matter for April 19, 1999 be vacated because the parties have resolved this dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for April 19, 1999, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHERED ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
