This matter is set for hearing on April 15, 1999. On March 18, 1999, Mr. Lee Young, President of Young Properties, withdrew Appellant Crabtree Auto Center’s request for a hearing, as the matter had been mutually resolved with the Arizona Department of Environmental Quality (“Department”) at an informal settlement conference. A contested case may be resolved by agreed settlement of the parties. Arizona Revised Statutes § 41-1092.07(F)(5). Accordingly, IT IS ORDERED vacating the hearing in this matter. IT IS RECOMMENDED to the Director of the Department that this appeal be dismissed. ORDERED AND SUBMITTED this 23rd day of March, 1999.
