IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On April 2, 1999, the undersigned Administrative Law Judge received a letter from Al Scremin requesting the cancellation of his formal appeal and that the hearing scheduled for April 6, 1999 be vacated because the parties have reached a settlement.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for April 6, 1999, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHERED ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
