IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Prior to the date set for the hearing in the above-entitled matter, Appellant Red Mountain Mining, Inc. informed the Office of Administrative Hearings that the Arizona Department of Environmental Quality had resolved the matters in dispute to Appellant’s satisfaction. In view of the parties’ settlement, IT IS ORDERED that the hearing scheduled to convene on December 15, 1999 be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED that this matter be remanded to the Director of the Arizona Department of Environmental Quality with the recommendation that this appeal be dismissed.
