Prior to the date of the scheduled hearing, Appellant filed a notice with the Arizona Department of Environmental Quality (“Department”), who forwarded a copy thereof to the Office of Administrative Hearings, which notice stating that this appeal is withdrawn and requesting the hearing be vacated. Accordingly, for good cause based upon the written notice received from Appellant, the above entitled case is vacated from the calendar of the Office of Administrative Hearings and the matter is remanded to the Department for further action according to law.
