Hearing in this matter was duly-scheduled to convene on October 26, 1999, at 9:00 a.m., before the undersigned administrative law judge of the Office of Administrative Hearings. On September 29, 1999, counsel for Virgin Valley Water District (VVWD) filed a document stating that based on representations of representatives of the Arizona Department of Environmental Quality, VVWD was withdrawing its appeal in this proceeding. For that reason, IT IS ORDERED that the hearing set for October 26, 1999 be vacated from the calendar of the Office of Administrative Hearings, and that the matter be remanded to the Arizona Department of Environmental Quality for disposition consistent with the foregoing.
