IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On June 21, 1999, the undersigned Administrative Law Judge received a Withdrawal of Notice of Appeal from Attorney Roger K. Ferland, counsel for the Appellant. The Appellant has withdrawn its Notice of Appeal because the parties in this matter have resolved their dispute.

Based upon the foregoing, IT IS ORDERED that the hearing scheduled for August 3, 1999, at 9:00 a.m. shall be vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHERED ORDERED that this matter shall be remanded to the Arizona Department of Environmental Quality for any further action that the Director deems appropriate.
