IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The Arizona State Board of Nursing, through counsel, has filed a motion to continue the scheduled hearing in this matter because Respondent has withdrawn his request for a hearing and the Board wishes to consider Respondent’s action at its next meeting at the end of June, 2000. The pending motion contains written correspondence from the Respondent which expresses his intention and desire not to contest the allegations contained in the complaint. Upon review and consideration of the contents of the pending motion, it is determined that the granting of a continuance in this matter is not warranted. Rather, it is determined that the appropriate action is to vacate the hearing from the calendar of the Office of Administrative Hearings and to remand this matter back to the Arizona State Board of Nursing for its further consideration and disposition, pursuant to A.A.C. R2-19-111. IT IS ORDERED that the hearing set for June 20, 2000, at 1:30 p.m. be vacated and remanded to the Arizona State Board of Nursing. The Board may resubmit this matter to the Office of Administrative Hearings if a formal hearing is later determined to be required. Done this day, June 15, 2000.
