Prior to the date of the scheduled hearing, Arizona Department of Insurance (“Department”) filed a motion to vacate the hearing with the Office of Administrative Hearings, representing that after an informal settlement conference the Department received a notice of withdrawal of appeal from Petitioner. The Department does not object to the withdrawal of appeal and requests the administrative hearing set for October 6, 1999 be vacated. Accordingly, for good cause based upon the written representation received from Department , the above entitled case is vacated from the calendar of the Office of Administrative Hearings and the case is remanded to the Department.
