STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Immediately prior to the date on which the hearing in the above matters was scheduled to convene, counsel for the Arizona Department of Real Estate (herein called the “Department”) filed a document entitled “Notice of Settlement and Request to Vacate the Hearing,” confirming that the parties had effectively resolved all matters presently in issue by their mutual agreement to the entry of a Consent Order by the Department, thereby terminating this administrative action. Shortly following such filing, a copy of the proposed terms of such Consent Order, duly executed on behalf of all parties and counsel, was filed with this tribunal. In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS ORDERED that the administrative hearing scheduled to convene on February 7, 2000 be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the Commissioner of the Department for further appropriate action terminating this administrative proceeding as contemplated by and consistent with the parties settlement agreement and consent order.
