IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The State has filed a motion to deem admissions for failure of the Licensee to answer the Complaint. It has been previously established that the Director of the Department of Liquor Licenses and Control is the appropriate authority to deem admissions under A.R.S. §4-210(F). The State has not submitted any reason for altering what has been the established procedure in these cases. In view of the foregoing; IT IS HEREBY ORDERED that the motion to deem admissions is Denied; IT IS FURTHER ORDERED that the case is Vacated from the docket of the Office of Administrative Hearings and Remanded to the Department of Liquor Licenses and Control for final disposition.
