Prior to the commencement of the hearing, the parties mutually resolved the contested issues. The Administrative Law Judge did not participate in the discussions. The agreement was formalized in the record of the hearing. Parties may resolve a contested case by agreed settlement. Arizona Revised Statutes § 41-1092.07(F)(5). The terms of the agreement are that Respondent shall pay Complainant $175.00 in satisfaction of and for the release of any and all claims Complainant might have against Respondent arising from the events associated with this complaint, and Complainant withdraws its complaint. Complainant will prepare a written release, and Respondent shall make its payment thereafter. The Administrative Law Judge trusts the parties to fulfill their agreement. It is noted that Mr. Philip Coscia, the Registrar’s assigned inspector, did not find sufficient evidence for the Registrar to issue a citation, but the parties resolved this matter in the interest of expediting a conclusion. RECOMMENDED ORDER It is recommended that the Registrar: 1. Accept and approve the agreement of the parties set forth above. 2. Dismiss Citation and Complaint No. M98-3268.
