Complainant has filed a request to vacate the hearing in this matter set for tomorrow, October 7, 1998, at 9:00 a.m. and to dismiss his complaint without prejudice to timely refile it with the Registrar of Contractors. Complainant asserts that Respondent agrees with that request. In view of the foregoing, IT IS ORDERED that the hearing set for October 7, 1998, be, and hereby is, vacated, and that this matter be remanded to the Registrar of Contractors with the recommendation that the Citation and Complaint in this matter be dismissed without prejudice as requested by the Complainant.
