On June 29, 1999, the Registrar of Contractors ordered a rehearing in this matter. However, on or about July 21, 1999, the undersigned Administrative law Judge received a copy of a United States Bankruptcy Court Voluntary Petition from the Registrar of Contractors showing that the Respondent has filed a petition in bankruptcy, which has also incorporated an Order by the United States Bankruptcy Court containing an automatic stay of all proceedings against the Respondent.
In view of the foregoing, and in recognition of the mandate of the United States Bankruptcy Court under both the express and the automatic stays, IT IS HEREBY ORDERED that the rehearing (yet to be scheduled in this matter) must be vacated from the calendar of the Office of Administrative Hearings.
IT IS FURTHER ORDERED that this matter be remanded to the Registrar of contractors with the recommendation that the entire Citation and Complaint in Case Number 98-2649 be closed on October 1, 1999, unless the Complainant files written confirmation that an action seeking relief from the automatic stay has been initiated and perfected in the appropriate federal court.
